TERMS OF SERVICE – TAMITAN

1. Introduction
These Terms of Service (“Terms”) govern your use of the Tamitan mobile application and related services (“Tamitan”, “we”, “our”, “the App”). By downloading, accessing, or using Tamitan, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the App. Tamitan is operated by Monoloco Ltd, an Israeli company, and these Terms are subject to Israeli law.
2. What Tamitan Is
Tamitan is a peer-to-peer marketplace that connects people who want to sell items with people who want to buy them. In many cases, the seller delivers the item directly using their own vehicle (“trunk delivery”).
Tamitan provides the platform, but:
• We are not the buyer or the seller.
• We do not own the items listed.
• The actual sale contract is between the buyer and the seller.
3. Who May Use the App
To use Tamitan, you must:
• Be at least 16 years old.
• Have the legal ability to enter into an agreement.
• Provide accurate and up-to-date information during registration.
• Comply with these Terms and all applicable laws.
We may suspend or close accounts that violate these rules.
4. Your Responsibilities as a User
You agree not to:
• Use the app for illegal activities.
• Sell stolen, illegal, or dangerous items.
• Post misleading information or fake listings.
• Harass, abuse, or threaten other users.
• Attempt to bypass our payment system or fees.
• Use bots, scrapers, or automated tools without permission.
You are responsible for your interactions with other users and for any content you post (text, images, reviews).
5. Listings and Content
As a seller, you must:
• Describe the item accurately (condition, defects, size, etc.).
• Upload real photos that represent the actual item.
• Only list items that you have the legal right to sell.
We may remove or hide listings that:
• Are illegal or prohibited.
• Contain offensive, hateful, or harmful content.
• Are clearly misleading or fraudulent.
• Violate intellectual property rights.
6. Delivery and Location
Tamitan uses location to help match buyers and sellers in the same area. Sellers often deliver items directly to buyers.
By using the app, you acknowledge that:
• Location access may be necessary for certain features (for example, finding nearby items).
• You can turn off location in your device settings, but this may affect how the app works.
• We do not share your exact live GPS route or home address with other users. Instead, we use approximate areas or specific meeting points.
You are responsible for choosing safe meeting points and using common sense when meeting other users.
7. Payments, Fees, and the 25₪ Operational Fee
Payments within Tamitan are processed securely by Cardcom and other authorized providers.
When you make a payment in the app:
• You authorize us and our payment provider to charge your selected payment method.
• Platform fees (such as a fixed 25₪ operational fee per transaction) are shown clearly before you confirm payment.
The 25₪ operational fee may work as follows (subject to the exact model configured in the app):
• The buyer is charged a 25₪ operational fee through the app.
• If the deal is completed, this amount may be taken into account as part of the total cost or displayed clearly in the payment breakdown.
• If the buyer cancels after the seller has already left to deliver the item or arrived at the meeting point, the 25₪ fee is not refunded to the buyer and may be transferred to the seller as compensation for time and travel.
Sellers are responsible for complying with any tax or invoicing obligations they may have under local law.
8. Order Flow and Cancellations
A typical order flow in Tamitan may include:
1) The buyer places an order for an item.
2) The seller reviews and either accepts or rejects the order.
3) Once accepted, the buyer pays the operational fee as shown in the app.
4) The seller delivers the item or meets the buyer.
5) The buyer inspects the item and either confirms or declines the purchase in the app.
If the buyer cancels:
• Before the seller has started traveling (has not left yet), the operational fee may be refunded, as stated in the app.
• After the seller has already left or arrived, the buyer may lose the 25₪ operational fee, which may be transferred to the seller as compensation.
The exact rules and scenarios are explained in the app and may be updated from time to time.
Tamitan may help mediate conflicts, but we are not obligated to resolve all disputes and are not responsible for the actions of users.
9. Ratings and Reviews
After a transaction, buyers and sellers may rate and review each other.
You agree that:
• Ratings should be honest and based on real experiences.
• Reviews must not contain hate speech, threats, or defamation.
• We may remove ratings or reviews that violate these rules or applicable law.
Ratings help build trust in the marketplace, and we encourage users to rate fairly.
10. Identity Verification (KYC)
Now or in the future, we may offer or require identity verification for some users or transaction
types. This might include providing an ID document or other information to a trusted verification provider.
Users who complete verification may be marked as “Verified” or similar in the app. This is intended to increase trust but does not guarantee behavior or performance.
11. Intellectual Property
All rights in and to the app, including design, logos, text, code, and graphics (excluding user-generated content), belong to Monoloco Ltd or its licensors.
You may not:
• Copy, modify, or distribute the app’s content without permission.
• Reverse engineer or attempt to extract the app’s source code.
• Use our trademarks or branding without our written consent.
12. Limitation of Liability
To the fullest extent permitted by law:
• Tamitan is not responsible for the quality, safety, legality, or description of the items listed by users.
• Tamitan is not responsible for delays, cancellations, or issues arising from user behavior.
• The app is provided “as is” and “as available”.
We do not guarantee that the app will be error-free, always available, or completely secure.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel.
Any dispute arising from or relating to these Terms or your use of Tamitan will be subject to the
exclusive jurisdiction of the competent courts in Tel Aviv, Israel.
14. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will inform you through the app or other appropriate means. The “Last Updated” date at the top indicates the latest revision.
By continuing to use Tamitan after changes take effect, you agree to the updated Terms.
